No demolition linked to Bahraich violence before next hearing: UP govt assures Supreme Court

NEW DELHI: The Supreme Court on Tuesday received assurance from Government of Uttar Pradesh that no demolition measures will be taken against buildings belonging to people allegedly involved in the affair. Bahraich violence October 13 until tomorrow.
This follows community clashes which occurred during the immersion procession of Durga idols, leading to the death of Ram Gopal Mishra (22) and increased tensions in the region.
This comes after the state Public Works Department (PWD) issued a demolition notice on October 18 for the residence of Abdul Hameed, one of the accused in the violence, citing illegal construction on his property. Similar orders were later issued against other people allegedly involved in the Bahraich incident.
In response, three petitioners, including Hameed, filed a petition in the Supreme Court through their lawyer Mrigank Prabhakar, challenging the demolition notices. They argued that the action was not about unauthorized construction but rather “a punitive measure disguised as a legal measure.”
The petitioners claimed: “The defense of ‘unauthorized construction’ is being used as a ruse to carry out punitive demolitions and also to illegally circumvent the interim protection orders issued by this Court on September 17, 2024.”
The petitioners further alleged that the rapid initiation of the demolition process reflected malice and was directly linked to communal violence. They said in their plea: “The trigger for the proposed demolition notices is the close proximity to the community fire and violent incident and the contested notice, based on the perception of OR the alleged involvement of the owners/ residents/occupants in this incident. suspected criminal activity. »
The Supreme Court has not yet ruled on the petition. SC will on Wednesday hear a plea filed by three accused in the Bahraich communal violence incident against the demolition notices issued by the Uttar Pradesh government.
