New trial date set for Greeley man accused of killing girlfriend’s 18-month-old child – Greeley Tribune

A man accused of killing his girlfriend’s 18-month-old baby in July 2021 will face trial in late January.

Andy Carter, 29, appeared Wednesday afternoon before Weld District Judge Timothy Kerns for a status conference, where a new trial date was set for Jan. 27 following the Carter’s mistrial last week.

Carter also reached a deal in which he pleaded guilty to second-degree assault on a police officer in a July 2023 incident in which Carter repeatedly punched a Weld detention deputy who was attempting to getting Carter into his cell at the Weld County Jail.

As part of the agreement, the District Attorney’s Office dismissed several charges, including second-degree assault of a police officer involving bodily fluids in a January incident, introduction of contraband in August 2021 and riots at a detention center following an arrest in May 2022. In total, prosecutors dismissed four criminal charges and 13 misdemeanors, according to Colorado court records.

Carter’s murder case dates back to July 2, 2021, when he took his girlfriend’s 18-month-old daughter to the emergency room to be treated for a brain hemorrhage.

An investigation revealed the child’s injuries occurred at a home in the 2400 block of Ash Avenue in Greeley, where the child was in the sole custody of Carter – who was dating the child’s mother . Carter was arrested July 8 on suspicion of child abuse resulting in death, and has since been charged with first-degree murder of a victim under the age of 12 by a person in a position of trust and two counts of third-degree assault, according to Colorado. court records.

Carter’s preliminary hearing in February 2022 revealed evidence of past violent behavior, domestic violence and suspected prior child abuse.

Records show he pleaded not guilty to the first-degree murder charge on September 8, 2022, but no pleas were entered for the other charges in the case.

While incarcerated, Carter racked up several additional charges, most of which were dismissed Wednesday.

Kerns set a Nov. 22 deadline for filing additional motions in the murder case, so they can be discussed at a Dec. 5 motions hearing. Carter’s three-week jury trial is scheduled to begin Jan. 27. All procedures will take place. in Weld District Court.
