Americans demand the right to buy Hermès Birkin bags, add allegations of fraud and false advertising

U.S. consumers suing French luxury house Hermès have once again revised their lawsuit, hoping to convince a skeptical judge that the company is forcing shoppers to spend thousands of dollars on other products before they can buy one of his famous Birkin bags.

The three plaintiffs from the US state of California filed their third complaint on October 11, adding more allegations and details after Hermes asked the San Francisco court to dismiss the closely watched case.
The lawsuit still claims that Hermes only gives customers with “sufficient purchase history” a chance to purchase a coveted product. Birkin bagwhich are handmade and can cost thousands of dollars.

Consumers claim that Hermès is violating U.S. antitrust law by linking the purchase of other products to the ability to purchase a Birkin bag. The amended lawsuit added false advertising and fraud allegations.

Hermès and its salespeople “know that many of the people they encourage to buy ancillary products will not actually get a Birkin bag,” according to the lawsuit.
