Man pleads not guilty to rape, says acts were ‘consensual’

GREENUP A man accused of engaging in sexual acts with a mentally disabled woman at a local tire store pleaded not guilty Thursday.

In August, Darrell W. Hay, 49, was indicted by Greenup County grand jurors on two counts of first-degree rape, two counts of second-degree sodomy, one count of second-degree rape, of unlawful imprisonment and four counts of falsification of content. material evidence.

According to previous reports, Hay told investigators he had consensual sex with a woman who “wanted to have sex before she had brain surgery” and he “gave in to her.”

Investigators said that during an interview with the alleged victim’s family, she was found to be “mentally incapacitated” as a result of head trauma.

Hay appeared for his first appearance before Greenup Circuit Judge Brian McCloud on Thursday for arraignment, where his defense attorney, Bruce Blackburn, waived formal arraignment and pleaded not guilty to all counts indictment on behalf of Hay.

Blackburn also requested a formal bond modification hearing, now scheduled for October 24.

Hay is currently incarcerated at the Greenup County Jail on $100,000 cash bail.
