Cidco: Cidco to register as developer with MahaRERA for land sales |

Mumbai: In a recent judgment, Maharashtra Real estate Court of Appeal (MREAT) directed Cidco to register as a developer (Town Development) before MahaRERA within 30 days for its ongoing projects, similar to a 2017-18 program, for the transfer of plots. He further directed Cidco to register as a promoter (TD) with MahaRERA for its future. city ​​development projects launched under its program similar to that of 2017-2018, before advertising, selling or marketing its planned lands.
The MREAT was hearing an appeal filed by MCHI, Raigad, against a MahaRERA order passed in June 2019. The order stated that the sale transactions carried out by Cidco were sales of immovable properties, for which development permissions for the immovable properties were not available. had not yet been granted. by the planning authority, and such transactions did not fall within the definition of a real estate project. MCHI filed a complaint with MahaRERA in October 2018, citing non-registration of Cidco as a project developer with MahaRERA before launching a land allocation/sale program through competitive bidding. MCHI argued that its members had rights as allottees under the Real Estate (Regulation and Development) Act, 2016 and that Cidco was a developer.
The MREAT said it was abundantly clear that Cidco’s roles under the said scheme, in the complaint, involved development works under Section 2
